This paper argues that “free will” is vague. The argument has two steps. First, I argue that free will is a matter of degrees and, second, that there are no sharp boundaries separating free decisions and actions and non‐free ones. After presenting the argument, I focus on one significant consequence of the thesis, although others are mentioned along the way. In short, considerations of vagueness help understand the logic behind so‐called manipulation arguments, but also show why these arguments are ultimately (...) flawed. (shrink)

This is a draft of my chapter on Negligence for the forthcoming Oxford Handbook in Moral Psychology. It discusses philosophical, psychological, and legal approaches to the attribution of culpability in cases of negligent wrongdoing.

In this paper I tried to find a harm based solution to the non-identity problem. I explore the view upon which future persons are harmed if we prevent them from having what it is required by the Principle of Utility.

Public reason liberalism is defined by the idea that laws and policies should be justifiable to each person who is subject to them. But what does it mean for reasons to be public or, in other words, suitable for this process of justification? In response to this question, Kevin Vallier has recently developed the traditional distinction between consensus and convergence public reason into a classification distinguishing three main approaches: shareability, accessibility and intelligibility. The goal of this paper is to defend (...) the accessibility approach by demonstrating its ability to strike an appealing middle course in terms of inclusivity between shareability and intelligibility. We first argue against Vallier that accessibility can exclude religious reasons from public justification. Second, we use scientific reasons as a case study to show that accessibility excludes considerably fewer reasons than shareability. Throughout the paper, we connect our discussion of accessibility to John Rawls’s model of public reason, so as to give substance to the accessibility approach and to further our understanding of Rawls’s influential model. Theories of emotional justification investigate the conditions under which emotions are epistemically justified or unjustified. I make three contributions to this research program. First, I show that we can generalize some familiar epistemological concepts and distinctions to emotional experiences. Second, I use these concepts and distinctions to display the limits of the ‘simple view’ of emotional justification. On this approach, the justification of emotions stems only from the contents of the mental states they are based on, also known as their (...) cognitive bases. The simple view faces the ‘gap problem’: If cognitive bases and emotions (re)present their objects and properties in different ways, then cognitive bases are not sufficient to justify emotions. Third, I offer a novel solution to the gap problem based on emotional dispositions. This solution (1) draws a line between the justification of basic and non-basic emotions, (2) preserves a broadly cognitivist view of emotions, (3) avoids a form of value skepticism that threatens inferentialist views of emotional justification, and (4) sheds new light on the structure of our epistemic access to evaluative properties. Famously, in the essay Inquiry Concerning the Distinctness of the Principles of Natural Theology and Morality (Prize Essay), Kant attempts to distance himself from the Wolffian model of philosophical inquiry. In this respect, Kant scholars have pointed out Kant’s claim that philosophy should not imitate the method of mathematics and his appeal to Newton’s “analytic method.” In this article, I argue that there is an aspect of Kant’s critique of the Wolffian model that has been neglected. Kant presents a powerful (...) attack of the idea that philosophy should proceed through the analysis of concepts and argues that we should give up the aim of arriving at “complete” concepts as one of its fundamental desiderata. Importantly, this attack of philosophy conceived as conceptual analysis is distinctive and original if one compares it with Kant’s critique of analysis in the Critique of Pure Reason, which rests on the idea that analysis is insufficient to ground substantial metaphysical truths. I also make an additional point: Scholars have debated whether the appeal to Newton’s analytic method involves a form of empiricism. I submit that this debate is ill-conceived because Kant uses a notion of “given concepts” that is indeterminate with respect to their a priori or a posteriori status. (shrink)

This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. The primary objective of this book is to open space for rethinking the relationship between art and politics. It seeks to combat one of the fundamental assumptions that has plagued many of the previous debates on this issue: that art and politics are distinct entities definable in terms of common properties, and that they have privileged points of intersection, which can be determined once and for all in terms of an established formula. This common sense assumption is rooted in a (...) transcendent illusion according to which there are more or less fixed characteristics that unify our terms, concepts, and practices in such a way as to guarantee their meaning. Against this substantialist approach, Radical History & the Politics of Art argues for a praxeological account that begins the other way around by analyzing specific cultural practices without presupposing a conceptual unity behind them. Such an orientation is radically historicist in the sense that it recognizes that all of our practices—be they linguistic, theoretical, aesthetic or political—are historically constituted and that they are necessarily part of a temporal dynamic. Hence the contingent nature of the labels used to classify various practices or even identify ‘practice’ as such. Radical history thereby proposes a significant departure from the extant debates on art and politics by maintaining that there is no ‘art’ or ‘politics’ in general, nor a singular relation between them. There are only historically constituted practices in various conjunctures, some of which have been labeled, through practical acts of denomination, as ‘artistic’ or ‘political.’ Instead of proposing one more response to the oft-repeated question ‘what is the relationship between Art and Politics?’ this book seeks to overcome the presuppositions that plague such a question. It thereby changes the very nature of the investigation by asking: ‘how do the diverse aspects of practices identified as ‘aesthetic’ and ‘political’ overlap, intertwine and sometimes merge in precise socio-historical force fields of action? This paper introduces a body of research on Organizational Behavior and Industrial/organizational Psychology that expands the range of empirical evidence relevant to the ongoing character-situation debate. This body of research, mostly neglected by moral philosophers, provides important insights to move the debate forward. First, the OB/io scholarship provides empirical evidence to show that social environments like organizations have significant power to shape the character traits of their members. This scholarship also describes some of the mechanisms through which this process of (...) reshaping character takes place. Second, the character-situation debate has narrowly focused on situational influences that affect behavior episodically and haphazardly. The OB/io research, however, highlights the importance of distinguishing such situational influences from influences that, like organizational influences, shape our character traits because they are continuous and coordinated. Third, the OB/io literature suggests that most individuals display character traits that, while local to the organization, can be consistent across situations. This puts pressure on the accounts of character proposed by traditional virtue ethics and situationism and provides empirical support to interactionist models based on cognitive-affective processing system theories of personality. Finally, the OB/io literature raises important challenges to the possibility of achieving virtue, provides valuable and untapped resources to cultivate character, and suggests new avenues of normative and empirical research. Interpretations of Kant’s account of the forms of “taking-to-be-true” (Fürwahrhalten) have generally focused on three such forms: opinion (Meinung), belief (Glaube), and knowledge (Wissen). A second distinction that has received comparatively less attention is that between conviction (Überzeugung) and persuasion (Überredung). Kant appears to use the distinction between the subjective and the objective sufficiency of a taking-to-be-true to characterize all of these forms. However, it is impossible to account for the differences between them by relying on this latter distinction alone. (...) In turn, this makes it difficult to fit all of these forms into a single classification of taking-to-be-true. In this chapter, I propose a new approach to conviction and persuasion that dissolves these problems. Conviction and persuasion are not single forms of taking-to-be-true with distinctive characteristics, yet it is not useful to treat them as “classes” of taking-to-be-true either. Rather, they are “operators” that determine whether a taking-to-be-true is apt or inapt, depending on whether it rests on a correct evaluation of the grounds we have. (shrink)

Scholars who favor shareholder primacy usually claim either that managers should not fulfill corporate duties of beneficence or that, if they are required to fulfill them, they do so by going against their obligations to shareholders. Distinguishing between structurally different types of duties of beneficence and recognizing the full force of the normative demands imposed on managers reveal that this view needs to be qualified. Although it is correct to think that managers, when acting on behalf of shareholders, are not (...) required to fulfill wide duties of charity, they are nevertheless required to fulfill a variety of narrow duties of beneficence. What is more, the obligation to fulfill these duties arises precisely because they are acting on behalf of shareholders. As such, this article 1) refines our understanding of the duties of corporate beneficence and 2) helps to identify which duties of beneficence are imposed on managers when they are acting on behalf of shareholders. It discusses in some detail contributions by Nevin Climenhaga, Christos Kyriacou, Michael Hannon, Kevin Wallbridge, Annalisa Coliva, and Genia Schönbaumsfeld.

This essay calls attention to a set of linguistic interactions between counterfactual conditionals, on one hand, and possibility modals like could have and might have, on the other. These data present a challenge to the popular variably strict semantics for counterfactual conditionals. Instead, they support a version of the strict conditional semantics in which counterfactuals and possibility modals share a unified quantificational domain. I’ll argue that pragmatic explanations of this evidence are not available to the variable analysis. And putative counterexamples (...) to the unified strict analysis, on careful inspection, in fact support it. Ultimately, the semantics of conditionals and modals must be linked together more closely than has sometimes been recognized, and a unified strict semantics for conditionals and modals is the only way to fully achieve this. The idea that healthcare should become more person-centred is extremely influential. By using recent English policy developments as a case study, this article aims to critically analyse an important element of person-centred care, namely, the belief that to treat patients as persons is to think that care should be ‘co-produced’ by formal healthcare providers and patients together with unpaid carers and voluntary organizations. I draw on insights from political philosophy to highlight overlooked tensions between co-production and values like equality and (...) liberty. Regarding equality, I argue that co-production compounds both problems of gender inequality in the distribution of care labour and the challenges associated with securing equal access to care. Turning to liberty, I identify important commonalities between co-production and republicanism in political philosophy, given their shared insistence on common citizens’ civic virtue. Then, I use against co-production some liberal arguments against republicanism, to highlight a problem of over-demandingness. In bringing my argument to a close, however, I wish to caution against hastily rejecting co-production as a policy programme. (shrink)

Most human actions are complex, but some of them are basic. Which are these? In this paper, I address this question by invoking slips, a common kind of mistake. The proposal is this: an action is basic if and only if it is not possible to slip in performing it. The argument discusses some well-established results from the psychology of language production in the context of a philosophical theory of action. :In this essay, I present an account of forgiveness as a process of emotional distancing. The central claim is that, understood in these terms, forgiveness does not require a change in judgment. Rationally forgiving someone, in other words, does not require that one judges the significance of the wrongdoing differently or that one comes to the conclusion that the attitudes behind it have changed in a favorable way. The model shows in what sense forgiving is inherently social, shows why we (...) should be pluralists about it, and provides a basis for arguing against the existence of necessary conditions of forgiving. ABSTRACT:The distinction between what I call nonelective obligations and discretionary obligations, a distinction that focuses on one particular thread of the distinction between perfect and imperfect duties, helps us to identify the obligations that carry over from principals to agents. Clarity on this issue is necessary to identify the moral obligations within “shareholder primacy”, which conceives of managers as agents of shareholders. My main claim is that the principal-agent relation requires agents to fulfill nonelective obligations, but it does not always (...) require discharging discretionary obligations. I show that the requirement to fulfill nonelective obligations is more far-reaching than has been acknowledged by most defenders and critics of shareholder primacy. But I also show that managers are not bound by certain discretionary obligations like charity, showing that their moral obligations are more circumscribed than the obligations that apply to human beings in general. Recent epidemiological research on the social determinants of health has been used to attack an important framework, associated with Norman Daniels, that depicts healthcare as special. My aim is to rescue the idea that healthcare has special importance in society, although specialness will turn out to be mainly limited to clinical care. I build upon the link between Daniels's theory and the work of John Rawls to develop a conception of public justification liberalism that is suitable to the field of (...) justice and health. I argue that, from the perspective of public justification liberalism, (clinical) healthcare deserves special status. (shrink)

The involvement of the public in the governance of genomics has become a topic of growing interest among scholars, practitioners and policy-makers. The implementation of public involvement programmes may be quite expensive, and the design and evaluation of public participation is a matter of controversy. Thus, this paper examines the justifications for public participation in the governance of genomic research to help understand whether public involvement is worthwhile and to provide a guide to the design of public participation. I identify (...) four primary justifications in support of public involvement. I argue that three of them have serious flaws: neither an increase in the stability of institutions, nor the positive effects on the virtues of individuals, nor the epistemic merits of participatory activities provide a solid ground for the engagement of the public in the governance of genomics. However, the ideal of legitimacy in the exercise of coercive power appears to lend strong support to public involvement programmes. Given that the reasons why public involvement is sought shape the design of the participatory activities, restricting the range of valid justifications promises to simplify the task of designing and evaluating public involvement. Philosophers of perception are familiar with the argument from illusion, at least since Hume formulated it to challenge a naïve form of realism. In this paper, I present an analogous argument but in the domain of action. It focuses on slips, a common kind of mistake. But, otherwise, it is structurally similar. The argument challenges some contemporary views about the nature of action inspired by Wittgenstein. The discussion shows how thinking about these common mistakes helps illuminate aspects of human agency (...) that tend to be overlooked whenever too much emphasis is placed on the rationality of human actions. RESUMEN: El tema de este trabajo es la reconstrucción de la teoría de la selección natural darwiniana. Me propongo esbozar la ley fundamental de esta teoría de manera informal a partir de sus aplicaciones en El origen de las especies de Darwin y presentar sus conceptos fundamentales. Presentaré la red teórica de leyes especiales que surgen de la especialización de esta ley fundamental. Supondré el estructuralismo como marco metateórico. Señalaré también algunas consecuencias que mi propuesta tiene sobre ciertas discusiones metateóricas (...) en torno a la teoría y, finalmente, relacionaré mi reconstrucción con otras reconstrucciones disponibles.ABSTRACT: This paper is about the reconstruction of the Darwinian Theory of Natural Selection. My aim here is to outline the fundamental law of this theory in an informal way from its applications in The Origin of Species and to make explicit its fundamental concepts. I will introduce the theory-nets of special laws that arisefrom the specialization of the fundamental law. I will assume the metatheoretical structuralist frame. I will also point out many consequences that my proposal has about a few metatheoretical discussions around the theory and, finally, I will relate my propose to other reconstructions available. According to epistemological disjunctivism (ED), in paradigmatic cases of perceptual knowledge, a subject, S, has perceptual knowledge that p in virtue of being in possession of reasons for her belief that p which are both factive and reflectively accessible to S. It has been argued that ED is better placed than both knowledge internalism and knowledge externalism to undercut underdetermination-based skepticism. I identify several principles that must be true if ED is to be uniquely placed to attain this goal. After (...) that, I use those principles to formulate a diachronic skeptical argument. This argument yields the counterintuitive conclusion that understanding a global skeptical hypothesis is all it takes for a rational subject to lose all her perceptual knowledge of the world. Next, I show that a popular Austinian move must reject one or another of the principles that underlie ED. I close by delineating a novel strategy that can block the diachronic skeptical argument while preserving all the principles. The key idea is that perceptual knowledge is grounded in primitive, perceptual and recognitional abilities. This view sheds new light on some puzzling features of global skepticism that have been noted by Descartes and Hume, among others. (shrink)

Norman Daniels’s theory of ‘accountability for reasonableness’ is an influential conception of fairness in healthcare resource allocation. Although it is widely thought that this theory provides a consistent extension of John Rawls’s general conception of justice, this paper shows that accountability for reasonableness has important points of contact with both utilitarianism and intuitionism, the main targets of Rawls’s argument. My aim is to demonstrate that its overlap with utilitarianism and intuitionism leaves accountability for reasonableness open to damaging critiques. The important (...) role that utilitarian-like cost-effectiveness calculations are allowed to play in resource allocation processes disregards the separateness of persons and is seriously unfair towards individuals whose interests are sacrificed for the sake of groups. Furthermore, the function played by intuitions in settling frequent value conflicts opens the door for sheer custom and vested interests to steer decision-making. (shrink)

In this paper, I distinguish three general approaches to public trust in science, which I call the individual approach, the semi-social approach, and the social approach, and critically examine their proposed solutions to what I call the problem of harmful distrust. I argue that, despite their differences, the individual and the semi-social approaches see the solution to the problem of harmful distrust as consisting primarily in trying to persuade individual citizens to trust science and that both approaches face two general (...) problems, which I call the problem of overidealizing science and the problem of overburdening citizens. I then argue that in order to avoid these problems we need to embrace a (thoroughly) social approach to public trust in science, which emphasizes the social dimensions of the reception, transmission, and uptake of scientific knowledge in society and the ways in which social forces influence both positively and negatively the trustworthiness of science. Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

Evidence from cognitive science supports the claim that humans and other animals see the world as divided into objects. Although this claim is widely accepted, it remains unclear whether the mechanisms of visual reference have representational content or are directly instantiated in the functional architecture. I put forward a version of the former approach that construes object files as icons for objects. This view is consistent with the evidence that motivates the architectural account, can respond to the key arguments against (...) representational accounts, and has explanatory advantages. I draw general lessons for the philosophy of perception and the naturalization of intentionality. (shrink)

Object files are mental representations that enable perceptual systems to keep track of objects as numerically the same. How is their reference fixed? A prominent approach, championed by Zenon Pylyshyn and John Campbell, makes room for a non-satisfactional use of properties to fix reference. This maneuver has enabled them to reconcile a singularist view of reference with the intuition that properties must play a role in reference fixing. This paper examines Campbell’s influential defense of this strategy. After criticizing it, a (...) new approach is sketched. The alternative view introduces representational contents to explain perceptual individuation. After arguing that those contents are not satisfactional, it is concluded that there is room for a third view of reference fixing that does not fit into the singularist/descriptivist dichotomy. Epistemological disjunctivism (ED) has been thought to solve the conditionality problem for epistemic externalism. This problem arises from externalists’ characterization of our epistemic standings as conditional on the obtaining of worldly facts which we lack any reflective access to. ED is meant to avoid the conditionality problem by explicating subjects’ perceptual knowledge in paradigmatic cases of perceptual knowledge via their possession of perceptual reasons that are both factive and reflectively accessible. I argue that ED’s account of reflectively accessible factive perceptual (...) reasons is also prey to the conditionality problem. After that, I submit that Stroud’s influential formulation of the conditionality problem relies on a methodological requirement that is potentially dissociable from ED. So, it is possible to put ED in the service of a more modest anti-skeptical strategy. I close by suggesting that this modest anti-skeptical strategy successfully undercuts the underdetermination-based skeptical paradox. Nevertheless, it does not have substantial advantages over some forms of epistemic externalism. (shrink)

Normative political theorists have been growing more and more aware of the many difficult questions raised by the discretionary power inevitably left to public administrators. This article aims to advance a novel normative principle, called ‘principle of restraint’, regulating reform of established administrative agencies. I argue that the ability of public administrators to exercise their power in accordance with the requirements of public reason is protected by an attitude of restraint on the part of potential reformers. Specifically, they should refrain (...) from any reform of an administrative agency that involves a switch to a considerably more loosely interconnected system of values underlying the work of that agency. To illustrate the importance of the principle of restraint, I examine a case from British health policy, showing that a recent reform of the National Institute for Health and Care Excellence well exemplifies the serious problems brought by any violation of that principle. Suele señalarse la fuerte influencia que la teología natural tuvo sobre Darwin en su conceptualización del fenómeno de la adaptación. La teoría de la selección natural explicaría el mismo fenómeno que los teólogos naturales querían explicar: la adaptación. Recientemente ha sido señalado, sin embargo, que la forma darwiniana de conceptualizar la adaptación es novedosa. Las adaptaciones de la teología natural presupondrían la idea de que los organismos existen para la realización y manutención del equilibrio natural establecido por el creador. El (...) punto de este trabajo discutir esta cuestión, asumiendo el marco del estructuralismo metateórico. The strong influence that natural theology had over Darwin’s conceptualization of the adaptation phenomenon is frequently noted. The natural selection theory would explain the same phenomenon that the natural theologist intended to explain: the adaptation. Recently has been claimed, on the contrary, that the Darwinian way of conceptualizing adaptation is new. The concept of adaptation from natural theology presupposes the idea that organisms exist for realization and support of the natural equilibrium stated by the creator. In this work I will discuss this point, assuming the metatheoretical structuralism frame. (shrink)

William Smith’s recent article criticises the so-called orthodox approaches to the normative analysis of healthcare resource allocation, associated to the requirement that decision-makers should abide by strictly procedural principles of legitimacy defining a deliberative democratic process. Much of the appeal of Smith’s argument goes down to his awareness of real-world processes and, in particular, to the large gap he identifies between well-led democratic deliberation and the messiness of the process through which the intuitively legitimate Affordable Care Act was created. This (...) reply aims to demonstrate that the ACA provides no counterexample to orthodox views, seizing this opportunity to explore the specific space that the procedural principles populating orthodox accounts are meant to regulate. Neither general questions of healthcare justice concerning, for example, universal access nor, relatedly, the activity of elected politicians falls within the natural scope of application of such principles, revealing a much more complex picture of the interactions between justice and legitimacy as well as substantive and procedural considerations than acknowledged by Smith. In the end, orthodox accounts of healthcare resource allocation turn out to provide a precious fund of theoretical resources for the normative study of administrators, which might be useful well beyond bioethics and health policy. The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the constraint (...) that a precedent imposes based on the relationship of the precedent court and the instant court. This article discusses the growth of the populist radical right as a concrete example of the scenario where liberal democratic ideas are losing support in broadly liberal democratic societies. Our goal is to enrich John Rawls’ influential theory of political liberalism. We argue that even in that underexplored scenario, Rawlsian political liberalism can offer an appealing account of how to promote the legitimacy and stability of liberal democratic institutions provided it places partisanship centre stage. Specifically, we propose a brand-new moral (...) duty binding ‘reasonable’ partisans committed to pluralism. This duty establishes conditions where partisans must strategically transform society’s public reason (i.e. transform the visions for society their parties campaign on) in ways that promise to attract back support from illiberal and antidemocratic competitors. While this strategic behaviour might seem impermissible, we show that Rawls’ distinctive account of sincerity in democratic deliberation is uniquely placed to justify it as perfectly ethical. O elenchus é o método pelo qual Sócrates evidencia as incoerências entre a tese de seu interlocutor e seu sistema de crenças. Na visão de Gregory Vlastos, o método utilizado por Sócrates no Teeteto não é elêntico porque ele não visa a refutação direta da tese inicial de Teeteto. Argumentando contra a visão de Vlastos defendo que Sócrates constrói ao final da primeira parte do diálogo objeções fundamentadas em premissas aceitas por Teeteto que culminam no objetivo clássico do elenchus. Além (...) disso, argumento que mesmo que Sócrates não tivesse de fato refutado a tese original de Teeteto, ainda poderíamos defender que o método é elêntico, pois Teeteto consente com as premissas que igualam sua tese a tese de Protágoras. En On the Origin of Species Darwin distingue explícitamente entre tres tipos de selección: la selección natural, la artificial y la sexual. Si bien la distinción entre estos distintos mecanismos es de suma importancia en la obra de Darwin, la tesis de este trabajo es que tanto la selección artificial como la sexual (...) no son mecanismos distintos de la selección natural. Studying evidence law as part of naturalized epistemology means using the tools and results of the sciences to evaluate evidence rules based on the accuracy of the verdicts they are likely to produce. In this chapter, we introduce the approach and address skeptical concerns about the value of systematic empirical research for evidence scholarship, focusing, in particular, on worries about the external validity of jury simulation studies. Finally, turning to applications, we consider possible reforms regarding eyewitness identifications and character evidence.

Radical skepticism relies on the hypothesis that one could be completely cut off from the external world. In this paper, I argue that this hypothesis can be rationally motivated by means of a conceivability argument. Subsequently, I submit that this conceivability argument does not furnish a good reason to believe that one could be completely cut off from the external world. To this end, I show that we cannot adequately conceive scenarios that verify the radical skeptical hypothesis. Attempts to do (...) so fall prey to one or another of three pitfalls: they end up incomplete, reveal a deep contradiction or recreate a non-skeptical hypothesis. I use these results to improve upon Pritchard’s recent attempt at undercutting radical skepticism. (shrink)

Unlike his theory of justice as fairness, John Rawls’s political liberalism has generally been spared from critiques regarding what is due to the disabled. This paper demonstrates that, due to the account of the basic ideas of society and persons provided by Rawls, political liberalism requires that the interests of numerous individuals with disabilities should be put aside when the most fundamental issues of justice are settled. The aim is to accommodate within public reason the due concern for the disabled (...) while upholding political liberalism. To achieve this aim, a revision of the basic ideas of persons and society is proposed. The idea of persons should be regarded as more fundamental than that of social cooperation, and persons should be defined in terms of minimal moral powers. (shrink)

Austere relationism rejects the orthodox analysis of hallucinations and illusions as incorrect perceptual representations. In this article, I argue that illusions of optimal motion present a serious challenge for this view. First, I submit that austere-relationist accounts of misleading experiences cannot be adapted to account for IOMs. Second, I show that any attempt at elucidating IOMs within an austere-relationist framework undermines the claim that perceptual experiences fundamentally involve relations to mind-independent objects. It is widely assumed that perception is a source of reasons (SR). There is a weak sense in which this claim is trivially true: even if one characterizes perception in purely causal terms, perceptual beliefs originate from the mind's interaction with the world. When philosophers argue for (SR), however, they have a stronger view in mind: they claim that perception provides pre- or non-doxastic reasons for belief. In this article I examine some ways of developing this view and criticize them. (...) I exploit these results to formulate a series of constraints that a satisfactory account of the epistemic role of perception should fulfil. I also make a positive suggestion: coherentists are right when they claim that only beliefs can be reasons for other beliefs. Nevertheless, I depart from traditional coherentism, for I do not buy its conception of perception as bare sensation, nor explicate the justificatory status of beliefs in terms of coherence. My point is rather that, when one invokes experience to justify a belief, the justifying state must have structural features of beliefs. (shrink)

Duties of beneficence are said to allow for leeway to discharge them. By distinguishing between two different types of leeway, Mejia identified three structurally different duties of beneficence. In this Commentary I deploy those distinctions to clarify the nature of a fourth type of duty of beneficence, one prompted by a global pandemic, a duty with a peculiar, and seldom recognized, conceptual logic. I provide some guidelines that should orient managers when they take themselves to be fulfilling such a duty (...) on behalf of shareholders. (shrink)

Xenophon’s conception of the dialectical method shares many similarities with Antisthenes’ point of view regarding the relation between language and reality. The key element supporting this reading is the parallel between Xenophon’s method of dialegein kata genē and Antisthenes’ method of episkepsis tōn onomatōn. In this paper, I claim that a correct understanding of both methods yields a clear structural proximity between the two Socratics on the issue of dialectics. Although they present some significant differences, which I will also explore, (...) I will argue that both variants express a single Socratic motive with regard to dialectics. That is that dialectics, in its basic structure, consists of organizing reality through discourse in order to make it comprehensible. In particular, this is done through establishing unified instances capable of comprehending a multiplicity. This nuclear position could also be extended to include middle Plato’s concept of dialectics. This concurrence takes up different forms in Plato, Xenophon and Antisthenes. Nevertheless, they share the same structure, which indicates quite plausibly a major characteristic of Socratic philosophies, as opposed to previous attempts by the Presocratics and the Sophists. Some have defended a Fregean view of perceptual content. On this view, the constituents of perceptual contents are Fregean modes of presentation (MOPs). In this paper, I propose that perceptual MOPs are best understood in terms of object files. Object files are episodic representations that store perceptual information about objects. This information is updated when sensory conditions change. On the proposed view, when a subject perceptually represents some object a under two distinct MOPs, then the subject initiates two object files (...) that both refer to a. My defense of this view appeals to its satisfaction of four constraints that I argue theories of perceptual MOPs should satisfy. Furthermore, I show that some existent accounts of perceptual MOPs fail to satisfy them. The defended constraints also indicate what is unique about perceptual, as opposed to linguistic or cognitive, MOPs. (shrink)

The rule account of self-conscious thought holds that a thought is self-conscious if and only if it contains a token of a concept-type that is governed by a reflexive rule. An account along these lines was discussed in the late 70s. Nevertheless, very few philosophers endorse it nowadays. I shall argue that this summary dismissal is partly unjustified. There is one version of the rule account that can explain a key epistemic property of self-conscious thoughts: Guarantee. Ground offers the hope of vindicating and illuminating an classic philosophical idea: the layered conception, according to which reality is structured by relations of dependence, with physical phenomena on the bottom, upon which chemistry, then biology, and psychology reside. However, ground can only make good on this promise if it is appropriately formally behaved. The paradigm of good formal behavior can be found in the currently dominant grounding orthodoxy, which holds that ground is transitive, antisymmetric, irreflexive, and foundational. However, heretics (...) have recently challenged the orthodoxy. In this paper, I examine ground’s ability to vindicate the layered conception upon various relaxations of the orthodox assumptions. I argue that highly unorthodox views of ground can still vindicate the layered conception and that, in some ways, the heretical views enable ground to better serve as a guide to reality’s layering than do orthodox views of ground. The scientific revolution of the XVII siècle is normally described as erasing final causes and the teleology of physics. Nevertheless, the functional language plays a central role in certain areas of biological practice. This is why many philosophers have tried to explicate the concept of function, sometimes to defend the relevance of its use, some other times to show that it is merely a way of speaking that could be easily eliminated without any relevant information loss. The principal purpose of (...) this paper is to show the necessity of appealing to functional concepts for an adequate reconstruction of the Darwinian natural selection theory. Thus, functional language is used in the conceptualization of the theory’s domain of application, and that domain should be determined independently of the natural selection theory. (shrink)

Modern physics was born in the XVII century and soon became the scientific paradigm. The key to its success was the use tht Newton made of mathematics. I hold that Newton’s analysis of mechanics contains flwas which led to its crisis at the end of the XIX century and at the same time had resources to overcome this crisis. I study in this paper the epistemological reasons for these vicissitudes using Polo’s theory of knowledge.
